Do not choose by duration alone

Confirm why that contract type applies, the exact start and end dates, renewal and cancellation rules, rent and charges, deposit, inventory, permitted occupants and who must register the agreement.

The main residential contract names

Open-market contract: 4+4

The commonly called contratto a canone libero uses an initial four-year period with a further four-year renewal framework. “4+4” does not mean a tenant can never leave earlier: read the contractual withdrawal clause, notice period and legally applicable serious-reason provisions.

Agreed-rent contract: 3+2

A canone concordato contract follows local agreements on rent calculation and conditions, usually with an initial three-year term and a two-year continuation framework. Verify that the property, rent and documentation meet the local agreement rather than relying on the heading.

Transitory contract

A contratto transitorio is designed for a genuine temporary housing need. The temporary reason and supporting requirements matter. A short duration chosen only for convenience may not satisfy the legal framework.

Student contract

A student agreement is a form intended for eligible university students in qualifying locations and normally reflects local rules. Check enrolment, residence and duration requirements for the specific case.

Registration is evidence you should keep

The Italian Revenue Agency states that rental contracts lasting more than 30 days in a year must generally be registered. Registration is due within 30 days of signing or the earlier contract start. Ask for the registration receipt and keep it with every signed page and attachment.

A contract that someone promises to register “later” without a clear process is not finished paperwork. Confirm who will file it, when and how you will receive proof.

  • Full names and tax codes of every party
  • Exact property address, unit and included spaces
  • Start, duration, renewal and tenant withdrawal
  • Monthly rent, due date and permitted payment method
  • Building charges, utilities and annual adjustments
  • Deposit amount, permitted deductions and return process
  • Furniture inventory and condition report
  • Repairs, maintenance and alterations
  • Subletting, guests, pets and number of occupants
  • Registration costs and tax regime where applicable

Deposit and payment sequence

Separate the security deposit from advance rent, agency commission and any reservation proposal. Each payment needs a stated purpose, recipient, due date and refund rule. The name on the bank account should make sense in relation to the owner, agency or authorised representative.

Photograph the condition at handover and sign an inventory. A deposit dispute is much easier to prevent with dated evidence than to reconstruct at the end.

Before you sign or transfer money

  1. Match the signer's identity to the verified owner or authorised representative.
  2. Confirm the exact apartment through an in-person or robust remote viewing.
  3. Read the complete draft, including referenced attachments.
  4. Write down the payment and key-handover sequence.
  5. Ask how and when registration proof will arrive.
  6. Use qualified legal advice when a clause or eligibility question matters to your rights.
